We understand that the death of a loved one can be a difficult time.
Probate is the official recognition of a legally valid will by the Supreme Court of Queensland. This recognition is often required before an executor of a deceased estate can administer the estate and deal with estate assets. For example, you may need a grant of probate because a financial institution or aged care facility will not release funds without sighting the grant.
Not all estates will require probate. We can advise you on the appropriate steps before any action is taken.
Navigate Law can help you by:
- Advising executors and trustees in regard to their duties and rights
- Advising on whether it is necessary to apply for a grant of probate
- Applying for Probate of the Will in the Supreme Court
- Dealing with intestacy (where there is no Will)
- Applying for Letters of Administration with a Will (where someone other than the executor named in the Will is applying)
- Selling or transferring estate property
