Family Transfers
Sometimes situations may arise where related parties, such as family members, wish to transfer property interests between them.
For instance, a parent transferring property to their child.
We can assist with preparing the transfer and any associated agreements related to the transfer, such as a Granny Flat Agreements for Centrelink purposes, if applicable.
Stamp duty will most often be payable on a transfer between related parties based on the fair market value of the property.
Matrimonial Transfers
Often when couples separate, they may agree that one of them will retain the home and the other will transfer their interest in the property.
You will require a conveyancing lawyer to assist with the transfer documents and other forms. If there is a mortgage on the property, the loan will also need to be re-financed.
Stamp duty exemptions may apply where you have a Court Order or Binding Financial Agreement in place dealing with the transfer of the property.
